Business Contract Disputes Due to Inappropriate Translation

Abstract
Each year, there are many business contract disputes appear because of inappropriate translation. This paper is to discuss this problem with methods of case study, comparison and e*ample analysis. The paper is mainly divided into four parts: 1) specific case study; 2) reasons of the emerging of this problem; 3) ways to avoid these inappropriate translations; 4) conclusion. In the first part, a specific case of business contract dispute will be highlighted to give readers a more objective understanding of this problem. We require that Northwest Translation Industry Company pay our financial loss 30,400 Yuan and reputation loss 5,000 Yuan. Defendants statement: Translation mistakes are unavoidable; few translation mistakes are acceptable by national translation quality standard. As the two companies signed no literary translation contract, and made no specific agreement on the standard of translation quality, the translation mistakes stated by Northwest Fu Lai industrial and commercial company cannot prove the breach of our company. So we disagree the requirement of paying for the financial loss of Northwest Fu Lai industrial and commercial company.
In this case, the defendant’s statement contains a sense of quibble. Contract is a kind of black letter law (a law that should follow close line to literal translation). The Northwest Translation Industry Company even made mistakes in translating the name of the client. So the defendant of this law case was surely end in failure.
Reasons of This Problem
This kind of law case appears every day. Companies like Northwest Translation Industry Company they surely do not make mistakes deliberately, as nobody wants to assume legal responsibility. However, no matter how hard the translators try, inappropriate translation emerges sometimes. Why this problem appears? A main reason is culture difference. Translation, no matter how many definitions there are, is basically a communication language. It is also a cultural approach of transplanting. We would like to say it deals with deferent cultures rather than different languages.
